SBD Insider Access Employee Referral Policy
Purpose:
The purpose of the SBD Insider Access (f/k/a as the Affinity Store) Employee Referral Policy (the “Policy”) is to reward eligible employees for acting as Brand Ambassadors and encourage qualifying referrals to SBD Insider Access . SBD Insider Access can be found here: https://sbdinsideraccess.stanleyblackanddecker.com or such other URL as the Company may determine (the “Site”).
Eligibility:
- All active, non-union full-time and part-time employees based in the USA are eligible to participate.
- L5+ employees are not eligible.
- Temporary, contract, interns or agency workers are not eligible.
- Retirees or former employees are not eligible.
- Referrals earned while the employee is on leave of absence are subject to review.
- Employees on a Sales Incentive Plan or Sales Commission Plan are not eligible.
- Purchases made after the Employee’s last date of employment will not qualify for a referral payment.
- Employees are eligible to receive a referral payment in the event of death, permanent disability, or retirement to be paid according to the referral payout timing.
- For employees who transfer to a new or different role, eligibility will be determined based on the employee’s status as of the first day of the month.
Referral Process:
The established referral process must be used to qualify for referral payments on referred purchases. Referral payments will not be paid for purchases made outside the established referral process. To invite guests, eligible employees are required to follow the SBD established process at time of referral, including but not limited to (i) inserting employee ID, (ii) providing the invited guest’s full name and email address on the invited guest form on the employee store site (https://employeestore.stanleyblackanddecker.com/account/login) and (iii) agreeing to the acknowledgment on the employee store site. Employees may not share, post or distribute content, screenshots and product information from the Site or this referral program in any offline or online forums or social media
Who Qualifies as a Referred Individual:
A referred individual must be an individual over the age of 18 and a legal resident of the United States. The Site is intended only for end-user customers who will use Products for personal, household, family, or bonified commercial use in the trades. Employees should not invite guests that are directly or indirectly involved in the commercial resale of tools, outdoor power equipment or similar products, parts or accessories. By participating, employees agree to notify SBD if employee becomes aware of or has reason to believe that an invited guest is purchasing product for resale.
A referred individual will be given access initially for thirty (30) days. After the invitee’s access expires, an employee would need to reinvite such individual and that invited guest would have to click on and accept the subsequent invitation(s) to regain access for purchases to be eligible for referrals payments. If a previously referred individudal accepts an invitation from a different employee to regain access, the employee whose invitation is accepted will be the referring employee.
Referral Payments:
- Employees will receive a referral payment of 3% of the net purchase amount (excluding taxes and shipping) for each eligible purchase made by a referred individual.
- The maximum total annual referral payment per eligible employee is $5000 annually.
Payment Terms:
- Referral payments will be calculated and paid monthly following the close of each month. Referral payments will be determined as soon as practical after results are finalized.
- Referral payments will be paid through the payroll system and following the applicable payroll schedule
- Referral payments are considered taxable income and will be processed along with applicable taxes and withholdings. Employees are responsible for any personal tax obligations arising from participation in this program.
- In the event that an overpayment is made, the Company reserves the right to recover the corresponding overpayment in accordance with the applicable law.
- Referral payments do not qualify for benefit withholding and are non-pensionable.
Exclusions and Limitations:
- Purchases made by employees, their household members, or via fraudulent means are not eligible.
- Orders that are canceled by customer or Company will not generate referral payments.
- Abuse of the program, including but not limited to reselling, creating fake accounts or making self-referrals, will result in disqualification and disciplinary action up to and including separation of employment.
- At any time, Company may designate certain customers ineligible for purchase through the Site (and thus rendering ineligible for purposes of referral payments) in its sole and absolute discretion.
- In the event the same invitee is invited by multiple employees, Company will make only one referral payment. In such circumstances, the first invitation that that the invited guest accepts will be determinative as to which employee receives the referral payment.
Program Modifications/Termination & Dispute Resolution:
- The Company reserves the right to modify, suspend, or terminate this program at any time without prior notice.
- Any disputes regarding referral eligibility or payment should be submitted in writing to the VP, Human Resources – Tools & Outdoor within 30 days of the issue arising.
Stanley Black & Decker (the “Company”) reserves the right, in its sole discretion at any time with or without notice, to amend, suspend, rescind or modify all or part of the plan herein, or their application, at any time. This plan is advisory in nature and creates no contractual obligation on you or the Company. Participation in this program is subject to all other Company policies, including but not limited to the Code of Conduct and Conflict of Interest Policy.
This Plan does not alter in any way your employment relationship with the Company, which is at-will. The Company retains all its rights to discipline or discharge associates who participate in the Plan. No written or oral statement by any employee, officer, director or agent of Stanley Black & Decker that is contrary to this disclaimer, or the guidelines stated in the document shall have any force or effect unless that statement is in writing by the VP, Human Resources – Tools & Outdoor.
